Terms of Use

1) Acceptance of Terms

By using the site or requesting access to our platform (including PaaS, hybrid, or on-prem deployments), you agree to these Terms and all referenced policies. If you do not agree, do not use XDevOps.

2) Service Description

• Event-driven, cognitive agent platform with an ontology-driven policy layer.
• Supports PaaS, hybrid, and on-premises deployments subject to separate commercial terms.
• Pre-release features may change; beta access is provided “as available.”

3) Eligibility & Accounts

• You must have authority to bind your organization (if applicable).
• Keep credentials confidential; you are responsible for activities under your account.
• Provide accurate, up-to-date information.

4) Acceptable Use

• No unlawful, harmful, or infringing activities.
• No interference, reverse engineering, or scanning of non-public endpoints.
• No attempts to bypass safeguards, quotas, or usage policies.
• No uploading of malicious code or abusing resources.

5) Third-Party Services

• Integrations (e.g., clouds, SCM, observability) are subject to their own terms.
• You are responsible for securing and lawfully using third-party APIs and data.

6) Customer Data & Confidentiality

• You retain ownership of Customer Data. You grant XDevOps the rights necessary to provide the services.
• We protect Confidential Information using reasonable technical and organizational measures.
• Pre-release programs may include telemetry to improve reliability and security—configured per documentation.

7) Intellectual Property

• XDevOps owns the platform, code, models, designs, and documentation.
• No rights are granted except as expressly stated in an order or agreement.
• Feedback may be used to improve the service without obligation to you.

8) Disclaimers

The site and pre-release features are provided “as is” and “as available.” We do not warrant that the services will be uninterrupted, error-free, or meet your requirements. To the extent permitted by law, all warranties are disclaimed.

9) Limitation of Liability

• No indirect, incidental, special, consequential, or exemplary damages.
• Aggregate liability is limited to the greater of: amounts paid in the 12 months prior to the claim or €100.
• These limits apply to the fullest extent permitted by law.

10) Indemnification

You agree to defend and indemnify XDevOps against claims arising from your breach of these Terms, unlawful use, or misuse of third-party services via the platform.

11) Suspension & Termination

• We may suspend or terminate access for violations, security risk, or non-payment (if applicable).
• Upon termination, your right to use the services ends; certain clauses survive (e.g., IP, confidentiality).

12) Changes to Terms

• We may update these Terms. We will post changes with an updated effective date.
• Continued use after changes constitutes acceptance.

13) Governing Law

These Terms are governed by applicable law where you reside or, if uncertain, the laws of France/EU, without regard to conflict-of-law principles. Venue and jurisdiction follow the governing law.
